General

The following terms and conditions (“The conditions”) apply to visitors (“Visitors”) of www.NabbiBioBeads.com and its subpages (“the Website”) and for those who:

  • buy physical products or digital products (“the Customer”).
  • pay for an add-on service (“the Customer”)
  • use digital products (“the User”)
  • create an account on the website (“the User”)

These terms and conditions (“the Conditions”) apply when you as a consumer or the business you represent (“the Customer”) places an order with us at www.NabbiBioBeads.com (“the Website”). The agreement is entered in Swedish (English?) between the Customer (in other words, you or the business you represent) and Munkplast AB, organisation number 556766-1631, (“Munkplast”). The terms and conditions apply to both consumers and businesses. Please note that in some cases, the terms and conditions differ depending on whether you place your order as a consumer or as a representative for a business.

If you place your order as an individual you need to be above the age of 18, shall not be under guardianship, and should in every other aspect have the capacity to enter agreements.

If you place your order on behalf of a business, you need to be authorised by the company to enter agreements on their behalf.

1. About NabbiBioBeads.com

NabbiBioBeads.com is a web shop run by Munkplast AB.

  • Munkplast AB is a Swedish business (organisation number 556766-1631)
  • Address: Hållnäsgatan 6, 752 28 Uppsala, Sweden.
  • PhotoPearls, NABBI and NABBI BioBeads are registered trademarks belonging to Munkplast AB.
  • If you wish to get in touch with us, please send an email to our customer service at support@NabbiBioBeads.com with your request and your contact details. We will get back to you within 1-3 working days (Monday-Friday).

2. Placing an order

  • Once you have completed your order an order confirmation will be sent to your email address. In the confirmation email you will find all details regarding products, prices, billing and delivery addresses.
  • If the information is incorrect in the order confirmation, you need to contact us immediately via e-mail at support@NabbiBioBeads.com.
  • Munkplast has the right, in individual cases, to refuse or change the order (for example if you have provided incorrect personal data).

3. Payment

You can pay for your purchase through card payment using the most common card types, or any of the other payment options provided by Klarna Checkout. Please read the terms and conditions for Klarna Checkout here.

4. Shipping

Parcels weighing a maximum of 500 grammes will be delivered with PostNord Varubrev. If the delivery is too big to fit into your mailbox, the postman will either ring the doorbell or send a notification about where you can pick your parcel up at the nearest service point.

Depending on the parcel’s measurements, parcels weighing more than 500 grammes will be delivered with either PostNord Varubrev or PostNord MyPackCollect to your closest service point. A notification will be sent to you via text or email.

The shipping cost is based on weight and is calculated and presented to you at checkout.

Our normal delivery time is 2-5 working days. Please note that orders placed during the weekend will be dispatched the following workday at the earliest.

5. Deliveries not collected

You are obliged to collect or receive your delivery according to the instructions given by NabbiBioBeads.com or the freight company. Depending on your choice of shipping method you will get a notification detailing where and when the delivery needs to be collected or received.

For parcels which are not collected or received, Munkplast has the right to charge a fee of 250 SEK including VAT for additional costs such as return shipping costs, expedition and handling fees. This will be sent to you as a separate invoice.

Deliveries not collected are not covered by the right of withdrawal.

6. Prices

All prices in the web shop are in SEK (Swedish Krona) and include Swedish VAT (25%).

We express our reservation for changes in pricing caused by price changes from supplier(s), misprints in the pricing list, and inaccuracies in pricing caused by incorrect information and we reserve the right to adjust the price.

7. Right of withdrawal

When purchasing products from the website, you as a consumer have a 14-day legal right of withdrawal according to the Swedish Act on Distance Contracts, which is valid from the moment you receive a product which you have ordered. The right of withdrawal only applies if the product has not been used and can be returned in its undamaged original packing and with the tags left.

7.1 When exercising your right of withdrawal, you must:

  • Notify us that you want to withdraw your purchase. The notification must be sent to us at kundservice@NabbiBioBeads.com. The notification must include your name, your address, e-mail address, and the order number, and which products you wish to return must be clearly stated. We will respond to your email and attach an address label which can be printed out and attached to the return parcel.
  • You should immediately and at the latest within the 14-days as specified by the law return the products to us.
  • You pay the return shipping cost. You are also responsible for the delivery and the condition of the products being returned. The products should therefore be packaged well for the return and should be in their original packaging.
  • You need to print, fill out and attach a return slip for us to be able to process your errand quickly and efficiently. Please download the return slip here.
  • We reserve the right to withdraw a sum from the reimbursement equal to the loss of value from the product’s original value in the case of used or damaged product(s).
  • You have the right to be reimbursed within 14 days of us receiving your notification and the product, if the right of withdrawal is applicable. The reimbursement will be completed by the same means with which payment was made.

7.2 The right of withdrawal does not apply when/for:

  • Services which have been completed and where you have explicitly consented to the service being started without a right of withdrawal.
  • Digital services and products are exempted from the right of right of withdrawal in accordance with the Swedish Act on Distance Contacts. Through completing a purchase of a digital product, you as the customer have consented to the right of withdrawal being derogated from by agreement.

8. Complaints

We inspect all products before they are sent to you. If the product nevertheless is damaged or incorrectly expedited when it arrives, we take it upon ourselves to, in accordance with applicable consumer law, rectify the mistake free of charge. You must always contact us for approval before you return a defect product. The complaint must be sent immediately after the defect is discovered.

8.1. How do you go about making a complaint?

Complaints about potential faults and defects always need to be communicated to support@NabbiBioBeads.com. The message needs to include your name, your address, e-mail address, order number and a description of the defect. We respond to your email and attach a prepaid address label which can be printed out and taped to the return parcel.

You need to print, fill out and attach a return slip in order for your errand to be handled quickly and efficiently. Please download the return slip here.

If we cannot resolve the issue or deliver a similar product, we will refund you for the defect product in accordance with applicable consumer law. We cover the shipping costs for the return in cases of approved complaints.

We reserve the right to deny a complaint if it turns out that the product is not faulty in accordance with applicable consumer law. 9. Limit of Liability

We do not accept responsibility for any indirect damage which could be caused by the product. We do not accept liability for delays and faults caused by circumstances outside of the company’s control (Force Majeure). These circumstances include but are not limited to labour dispute, decreased or defaulted deliveries from supplier(s), fire, authority decisions, and war.

In addition to this, we do not accept liability for potential changes in products and product properties changed by suppliers and other factors outside of our control.

10. Product information

We make a reservation against potential misprints on this website as well as against products being sold out.

We constantly update our range of products and services. The products or services available from our website can occasionally be incorrect, described incorrectly, or unavailable. We cannot guarantee that the information is correct or complete, including prices, product photos, specifications, and availability. We reserve the right to update current information, correct inaccuracies and update the current supply of products and services.

11. Information on cookies

According to law on electronic information, visitors of a website should, for integrity purposes, receive information that cookies are being used. The information in the cookie can be used to follow a user’s browsing. A cookie is a small text file which the website you are visiting asks to save on your computer to enable access to different functions. 12. Personal data

By shopping from us, you accept our data protection policy and our processing of your personal data. We respect your personal integrity and do not process more data than what is necessary to handle your order. We neither sell nor give your data to a third party without legal basis.

NabbiBioBeads.com is responsible for the processing of personal data which you as a customer have shared with us. Your data is processed by us to handle your order and in those cases where you have requested newsletters or campaign offers.

We always process your personal data in accordance with the General Data Protection Regulation (GDPR).

13. User account

If you create an account with us you must provide us with correct, complete and relevant information. Incorrect or false information constitutes a breach of the terms and conditions, which can lead to your account with our service being instantly terminated. You are responsible for protecting the password which you use to access the service and for activities or actions under your password. You consent to not sharing your password with any third party. You must notify us instantly when you become aware of a security breach or the unauthorised use of your account.

You may not use another person’s name as username or a username which is not legally available for use, a name or a brand which is subject to any other person’s or unit’s rights without appropriate permission, or a name which is otherwise offensive, vulgar, or obscene.

We can terminate or close your account with immediate effect, without prior notice or liability, for any reason, including, without limitation, if you break the terms and conditions. After termination, your right to use the service is cancelled with immediate effect.

14. Changes to the terms and conditions

We reserve the right to carry out changes to the terms and conditions at any time. Changes to the terms and conditions will be published online to the website. The changed terms and conditions are considered accepted at the placement of an order or visit to the website.

15. Content

With our service, you can upload, link, store, share, and otherwise provide certain information, text, graphics, videos, or other material (“Content”). You are responsible for the content which you post to the service, including its legality, reliability, and appropriateness. By posting content to the service you give us the right and licence to use, modify, conduct, show, reproduce and distribute such content on and through the service.

You keep all your rights to all content you send, publish, or show on or through the service and you are responsible for protecting these rights. You certify and guarantee that:

(i) The content is yours (you own it) or that you have the right to use it and you grant us the rights specified in these terms and conditions, and
(ii) the publication of your content on or through the service does not breach privacy rights, publication rights, copyright, contractual rights, or other persons’ rights.

15.1 Copyright policy

We respect the immaterial rights of others. It is our policy to respond to all claims that content posted to the service breach copyright rules or other infringements of immaterial rights (“infringement”) by any person.

If you are a copyright holder or are authorised on behalf of one and you believe that the work protected by copyright has been copied in a way which constitutes an infringement of copyright through the service, you need to send a message in written form to support@NabbiBioBeads.com and include in your message a detailed description of the reported violation.

You as the user of services according to these terms and conditions can be held responsible for damages (including legal and solicitor’s fees) for the unlawful use of material protected by copyright.

15.2 Provocative material

Images uploaded to the service must not be offensive, distasteful or portray something which can give sexual, racist, ethnic or religious allusions in an inappropriate manner.

16. Disputes and Choice of Law

In case a dispute cannot be settled amicably between the company’s customer service and the customer, you as the customer can turn to the Swedish National Board for Consumer Disputes (ARN), please see www.arn.se/om-arn/Languages/english-what-is-arn/.

Customers living in an EU country other than Sweden can file a complaint online via the European Commission’s platform for mediation in disputes, please see http://ec.europa.eu/consumers/odr.

In case of a potential dispute, we follow the decisions from ARN or the corresponding dispute settlement body. Disputes regarding the interpretation or application of these conditions shall be interpreted according to Swedish law.
